I have been on WC for 23 years. I got so tired of waiting for my lawyer to do anything but blah blah me on.

Then last Christmas I got a biggg package from Medicare Secondary. It said that the judge had ordered a medicare set-aside for future medical and it needed to be signed. The amount on the page was $1,000,000. Yea, one million dollars. It was more than 3 years old.

Then I called on New Years Eve he told me"It"s just a form letter."

So I fired him. Then I had to have that 8 level surgery. They denied it.

So I let a friend know what was happening and he looked at the papers and asked me..."do you know WHAT THEY WERE DOING?" WAITING FOR YOU TO DIE.

Unbelievable but true. They can do that without getting disbarred?

This happen to anyone else?

Edit: since he worked for part of what I got, it seems like "someone?" had to be paying him all that time. Surely he wouldn't do this for nothing. Today WC said it was settled in 1991. Then why was it on the table in 2011?

Was it a wc atty for your side/representing you??
Or the atty for the wc ins?

In most states your wc atty only gets paid after the case is closed or settled.

Usually 22% I think, but then tops out at 5k.
It's been many years so I could be off on the amounts and other states may differ.

It did state how much $ & % plus any other fees on the contract I signed when I hired my wc atty.

I've heard others mention medicare set aside in the past, but I didn't understand how that worked...

You might do some searches to find out more about it.

Default My lawyer supposedly got nothing.

Yes, I hired him. The company hired a lot of lawyers. THat is what I meant, they only get a % of what you get. So if they "settled" for nothing but medical, and I might add, in December it was still active and I had fired him, so if it was settled without my knowledge for medical only, then not only did someone sign my name illegally but there was no settlement. So he would get % of nothing. I don't think a company representing a client would take that chance for nothing. Someone must have been paying him. Lots.

Thanks for the answer. I am thinking of calling 48 hours or something. HOw could this happen in this day and age?

Help me brainstorm. It's unreal.

I'd contact the state work comp division , if a claim gets settled or closed they should have it recorded and on the record.

For oregon you can search the state website for wc judgements.

I don't know if the wc ins company would send you copies of everything to date, but it's worth a try to ask.

Do you have a new atty now, or none??

The old atty should have copies to turn over to you also...if not contact the state wc div or the state bar...
If you can find your contract with that atty look thru it for details, maybe it mentioned giving him power to sign things??

But basically you need to find out exactly what happened and if someone did forge your name and to do that you need the paperwork.


I was always sent copies and if things needed to be signed I got that and a stamped /addressed envelope to return it, or faxed it.

Did you do a search of that attys name to see if any other negatives came up? you might find out things that way too.
Also check him on that state's bar association page.

something is definitely fishy. Not only would I call the wc board, but if you find that there is a settlement and you didn't sign you need to call the AG office in your state and file a complaint. Then call the board of professionals and report the atty.

Default finally getting it looked into

I AM HAVING SOMEONE WORK ON IT.

My thought was exactly that. A workers Comp attorney doesn't get paid exact for a percentage. So if he knew, and he ***must**** have because he had the **million dollar paperwork** sent to a VERY wrong address in another state.

They CC'd him on it when they sent it. THree years before I saw it finally.

So someone is / was paying him something. He didn't keep his business going all those years for $nothing.
