social security remand hearing yesterday

Default social security remand hearing yesterday

well we had the remand hearing yesterday, the hearing went well, but ss sent me to a medical exam in sept. and the report that doctor wrote was terrible for me. My lawyer and I did not see the report until just before the hearing. even though I ask for a copy to be sent to my doctor. first of all the exam did'nt even last 5 min. the dr never had any of my medical records, never new about my triple spinal fusion or the surgery before that, never ask about the medications I am taking. He did a very brief exam on me,, I told him I can't even tie my own shoes, or even walk for 10 min. without severe pain in my back and left leg. He stated in his report I could walk for up to four hours climb any amount of stairs, and CRAWL. I was at a lose for words when I saw this, how in the world can this guy determine this without all that imformation and mri reports and catscan reports and exrays, wich I have had many of them. Can I sue this mother****er????? Of course I have my doctor and a therapist who say the complete opposite, and my doctor has treated me since my injury in 2005. My lawyer told me when we went in that we have a case to win, it just depends on the judge, who according to my lawyer is the worst in the state, and he has denied my once already. I am very close to being done with it ALL......... I just can't get a break in life.

I know exactly what you mean. I got the SAME kind of doctor, who looked at me with such DISGUST, like I was trying to BILK the system out of millions of dollars!!! He did NO exam -- just had me TRY to stand on my tip toes which I couldn't do. And that was basically it. But what he wrote in his report was that I was just fine. I could do ANY kind of work. He totally LIED about everything he said. I can't remember it all, but he was a real jerk!

Of course I had all the other doctors reports which said the exact opposite, so i don't know why they even send patients to him. he's a joke. But I was approved anyway!!

You need to call your senator & representative!! They made a difference in MY case, because I got approved after I called them.

I am so sorry for the report that one doc. gave you. I do not know how physicians can live with themselves knowing their evalutaiton may hurt someone so terribly. I was denied twice. It took a PCP a three page letter spelling out my condition addressed to the judge for me to be granted the disability. I had letters from at least 10 people I knew, a psychologist, neurologist, and 7 surgeries behind that. My lawyer that I had through the whole process never never let me give up. I went broke, but I am alive. Don't give up Bretd. Try to get a personal physician to write a letter directly to the judge. The system we have for disability is damaged. I think that is why all this happens. appeal, do what ever you have to, to get medical help. I will keep you in my thoughts and prayers. ginnie

Isn't it UNREAL how these idiots can make a claim such as this, and only have spent 5 minutes face-to-face with you!
Allow your faith to rise above this and stand on what the Word says, k!
I know how stressful this must be on you and your wife, especially with what you've been thru lately.

Thank you guys and girls for your support, it really helps. I have been in contact with my congressman the whole time. My lawyer was amazed when he saw how many inquiries there have been. My doctor did write a letter for me, a very good one at that. A physical therapist that wrote a report for the last hearing were she was a little iffy on me being able to do sit and stand work, looked over my new reports and concluded I am not able to do any type of work and sent a letter stating that. plus another RFC report from my doctor that is totally in my favor. I don't know, I am trying to have faith, but honestly I could lay in bed all day and cry. We filed bankrupcy last week and dont have the money for this month house payment wich was due 2 days ago, and we don't have any money at all for christmas for our 2 children and 2 grandchildren, how do you explain that to them.

hey brother.i have been there to..my sister "ginnie"can testify to that).where my whole problem only rely on a doctor "say so".he he thinks your just 'lazy"and trying to "bilk"the system.i had to use the judge in my case to win.then the doctor tries and "make it up"to you.unfortunately it came to his recommandation.which he wouldnt co-operate.i lost my job through him and almost my house.but one of the things that helped and kept me going was this site here..thank you jesus

Don't give up. Both Don and I did get the disability after a long amd grueling trail. I do know it is awful to go through, but it can and will turn out OK. You will get more opinions, and eventually someone will write what is necessary for them to listen to you. Do ask for help all you can to get through this. Mentaly it takes all your effort. Reach out to those that love you, and stick right here with Neruo Talk. We all talk through these situations, and get the support we need to go on. My children were grown when this happened, but my son still has had to help me in many ways. There are community programs that will help your children through the holidays so they don't feel so left out. Keep hope alive in your family. ginnie
